Our Discount Fuel Cards are provided by The Fuel Store Ltd with whom Assist Protect Ltd have a working relationship. The following Terms and Conditions are authored by The Fuel Store Ltd (defined below as We/Us/Our). Assist Protect Ltd are displaying these Terms and Conditions in full for reasons of providing you with full transparency.

Definition of We/Us/Our in these Terms and Conditions:

'We/Us/Our' means The Fuel Store Ltd (Company no. 08503258) whose registered address is 14th Floor, Bank House, 8 Cherry Street, Birmingham, England, B2 5AL.

Purpose of these Terms and Conditions

The following terms and conditions outline the contract that applies between you and us in relation to your top-up card (“Card”) and your Top-up Account where you are acting as a consumer. Under these terms and conditions, you purchase fuel from us. We are the supplier of the fuel to you, and Shell plc (our “Approved Supplier”) acts on our behalf in providing the fuel to you. Please ensure that you have read and understood these terms and conditions before using your Card. If you do not understand these terms and conditions, you may contact info@thefuelstore.co.uk to discuss your concerns with us. You can find everything you need to know about us on our website at www.thefuelstore.co.uk.

1 Introduction

These terms and conditions form the entire agreement between you and us and are the basis of a legally binding contract. These terms may have changed since you last reviewed them. For a list of changes and when they were made, please contact us on info@thefuelstore.co.uk.

2 Requesting the Card

We only accept orders when we've checked and are happy with them. We will contact you to confirm we've received your order and then we contact you again (normally within 3 working days) to confirm that the Card has been approved by us for issue (at our discretion). Sometimes we may decline an order, if this happens, we will let you know as soon as reasonably possible.

3 Your details

3.1 You should make sure that all details you provide in your order are accurate and you should immediately notify us in writing of any changes, including your name, address and bank details.

3.2 We process all personal data as set out in our privacy policy, which can be found at https://www.thefuelstore.co.uk/privacy-policy/.

3.3 Where you have been introduced to our services by a third party, we may disclose information relating to your use of the Card, including transaction data, fuel usage and account activity, to that third party for the purposes of administering and managing the services provided to you. Any such disclosure will be made in accordance with applicable data protection laws and our privacy policy.

3.4 We may be required to comply with applicable anti-money laundering and "know your customer" laws and regulations. You agree to provide us with such information and documentation as we may reasonably request from time to time to enable us to carry out identity verification and other checks required by applicable law. We may decline to issue a Card, delay the activation of a Card, or suspend or cancel a Card at any time if you fail to provide the requested information to our reasonable satisfaction or if we are otherwise unable to complete our verification checks. We will not be liable to you for any loss or inconvenience arising from any such refusal, delay, suspension or cancellation.

4 The Card

4.1 You may use the Card for purchasing standard unleaded and standard diesel fuel ("Fuel") from our Approved Supplier. The Card may not be used to purchase any goods or services other than Fuel, and may not be used at any location other than the Approved Supplier's participating forecourts.

4.2 The Card remains our property, and we may ask you to return it at any time, in which case you should do so without delay to The Fuel Store, 14th Floor, Bank House, 8 Cherry St, Birmingham B2 5AL.

4.3 The Card may only be used by the person registered to the Card.

4.4 We will send the Card to the address you provide in your order within 5 working days after we accept your order.

4.5 Except as set out in these terms and conditions, we do not charge any fees for the issuance, activation, use or topping up of the Card.

5 Using the Card

5.1 The Card is issued for your convenience only. Having the Card does not guarantee you will be able to purchase Fuel from our Approved Supplier.

5.2 The Card remains your responsibility at all times and may only be used:
    (a) by you, to purchase Fuel from our Approved Supplier up to the available Top-up Balance on the Card at the time of the transaction, and subject to any restrictions that apply to the Card or that we may notify you of from time to time;

    (b) for one transaction per 24 hours and up to a maximum value of £130 per transaction;

    (c) where the Card is presented to our Approved Supplier before the purchase (where required);

    (d) where you enter the PIN if our Approved Supplier requests it;

    (e) only if the card is valid, has not expired and has not been stopped or cancelled; and

    (f) in line with these terms and conditions and any instructions or procedures that our Approved Supplier provide.
5.3 We may change or remove the types of Fuel available for purchase using the Card at any time on reasonable notice to you. If we do this, we will inform you of the updated types of Fuel available and may issue you with a replacement Card.

5.4 Subject to clause 6, ‘Lost, Stolen and Expired Cards’, you are responsible for all purchases made using the Card and all amounts due under any transaction, regardless of who owns or was driving the vehicle.

5.5 You are responsible for the safe keeping and security of the Card, and the PIN. You are liable for all transactions made by an unauthorised person if you have given them the Card or PIN. If you disclose the PIN to an unauthorised person, you must notify us immediately and we may deactivate the Card.

5.6 You should take all reasonable steps to prevent the Card from being used fraudulently or otherwise misused.

5.7 The Card cannot be used as any kind of financial guarantee or to transfer any related debts to someone else.

5.8 You must not tamper with alter or interfere with any fuel monitoring or fuel delivery equipment on our Approved Supplier’s premises.

5.9 Our Approved Supplier may refuse to accept a Card that they reasonably believe is not being used in accordance with any restrictions placed on the Card.

6 Lost, Stolen and Expired Cards

6.1 If the Card is lost, stolen, mislaid, damaged, fraudulently copied or does not arrive when expected, it is considered compromised (Compromised Card). You must tell us as soon as possible if this happens by calling 0121 272 7780 or by emailing info@thefuelstore.co.uk and provide us with as much information in your possession as to the circumstances involving the Compromised Card.

6.2 You will remain liable for the use of the Card until you notify us, in writing, as soon as reasonably practicable that the Card has been compromised.

6.3 You shall remain liable for the use of a Compromised Card where it is established to our reasonable belief that:
    (a) you gave the Card to an unauthorised person;

    (b) the circumstances resulting in the Card becoming compromised were due to your fraudulence, negligence or wilful default; or

    (c) you were in breach of any provision in these terms and conditions.
6.4 If a Compromised Card is later found, you must not use it and must immediately destroy it by cutting through the magnetic stripe, the signature strip and the chip on the Card.

6.5 If you have notified us of a Compromised Card, we will provide you with a replacement card as soon as reasonably practicable and your Top-up Balance will remain at the level recorded at the time you notified us of the Card being compromised.

6.6 We will try to remind you when the Card is due for renewal, but it is your responsibility to request a replacement before it expires. We will not be liable for any direct, indirect or consequential loss you may suffer if you do not request a renewal or replacement card in accordance with this clause 6. All renewal requests must be made in writing to info@thefuelstore.co.uk. If you fail to renew the Card and the Card has expired, you will no longer be able to use it to purchase Fuel. Any remaining Top-up Balance at the date of expiry will be refunded to you in accordance with clause 9.1.

7 Charges

7.1 You acknowledge that when you use the Card to buy Fuel, you are purchasing that Fuel from us. We are the seller and supplier of the Fuel to you. Our Approved Supplier acts on our behalf (as our agent) in delivering the Fuel to you at the point of sale. Risk in Fuel, where relevant, will pass on delivery and title in Fuel will pass to you when you have paid for them.

7.2 Fuel purchased using the Card will receive a discount of 3 pence per litre, which will be based on the pump price at the time of purchase. We may change, vary, reduce or withdraw this discount at any time (acting reasonably). If we make a change to this discount, we will notify you in advance before doing so.

7.3 All prices for Fuel are the prices displayed at the Approved Supplier’s site at the time of purchase. These prices include VAT.

7.4 You are responsible for providing alternative means to pay for a transaction where the Card was not authorised.

7.5 You agree to all rates, fees and charges as outlined in these terms and conditions. Details of which are available on our website or by contacting us.

7.6 Any attempt to make a purchase using the Card from a third party that is not the Approved Supplier will be unauthorised and the Card will decline. You remain liable for the transaction, and you are responsible for providing an alternative method of payment.

8 Your Top-up Account

8.1 You are required to make an initial top-up of not less than £10 before a Card will be issued to you. Following issuance of the Card, you must top up your Top-up Account to a balance of not less than £60 (the Minimum Balance) before the Card will be activated for use. You can increase your balance (Top-up Balance) by topping up via direct debit, credit or debit card or any other payment method we may offer from time to time. Top-ups will only be added to your account once the payment has cleared.

8.2 The Minimum Balance is required only for the initial activation of the Card. Once the Card has been activated, your account will operate on a variable balance basis and there is no ongoing minimum balance requirement. Your Top-up Balance may not fall below £0. If your Top-up Balance reaches £0, the Card will be placed on hold and suspended, and you will not be able to use it until you make a further top-up. We may change the Minimum Balance from time to time and will notify you if we do so.

8.3 Where at least one Fuel purchase has been made using the Card but the Card subsequently remains unused and a Top-up Balance remains on the account, if the Card remains unused for a period of six (6) months from the expiry date of the Card, any remaining Top-up Balance shall be refunded to you in accordance with clause 9.1.

8.4 Your Top-up Balance is treated as an advance payment to us for future purchases of Fuel from us, as supplied by our Approved Supplier, and is not held on trust for you. The Top-up Balance may only be used to purchase Fuel from us in accordance with these terms and conditions.

8.5 You can only use the Card to purchase Fuel where the total value does not exceed your available Top-up Balance at the time of purchase. The Card cannot be used to pay for only part of a transaction.

8.6 Your Top-up Balance will be displayed in your online account. You can check your current balance at any time by logging into the portal. We may also provide notifications or alerts from time to time.

8.7 If you initiate any transaction that exceeds your available Top-up Balance, the transaction will be declined. You remain liable for any transaction where your Card declines and you are responsible for providing an alternative method of payment at the time of transaction.

8.8 Where a shortfall arises due to an operational, technical or timing error which results in a transaction being processed and the Top-up Balance falling into a negative amount, no credit is being provided to you and the full amount of the negative balance shall be immediately due and payable by you to us. You must immediately top up the Card to restore the Top-up Balance to at least £0 and to clear the value of the negative amount in full. The Card will be immediately suspended until the full top-up has been made and the negative balance has been cleared. We reserve the right to contact you to demand immediate payment of any such negative balance.

8.9 Your Top-up Balance will be refunded to you in the circumstances set out in these terms and conditions, including on cancellation of the Card (clause 9), in the event of a substantial interruption to the service (clause 10), or where we make material changes to the Card or these terms (clause 12). Except as expressly provided in these terms and conditions, we will not refund any remaining Top-up Balance.

9 You can end this contract and cancel the Card

9.1 You can end this contract at any time by emailing us at info@thefuelstore.co.uk. We may also end this contract at any time by giving you written notice. When this contract ends, the Card will be cancelled and we will refund any remaining Top-up Balance on your account to you within 30 days of cancellation, using the same payment method you used to top up the Card (or such other method as we may reasonably determine).

9.2 If you entered into this contract at a distance (for example, online or by email), you have a statutory right to cancel this contract within 14 days of the date on which the contract is entered into, without giving any reason (the "Cooling-off Period"). To exercise this right, you must notify us of your decision to cancel by emailing us at info@thefuelstore.co.uk before the expiry of the Cooling-off Period. If you cancel during the Cooling-off Period, we will refund all sums paid by you (including the initial £10 top-up) within 14 days of receiving your cancellation notice, using the same payment method you used to make the payment. If you have used the Card to purchase Fuel during the Cooling-off Period, you acknowledge that you will have requested us to begin providing the service during the Cooling-off Period and you shall remain liable for the value of any Fuel purchased up to the date of cancellation, which we may deduct from any refund due to you. This right is in addition to, and does not affect, your right to cancel at any time under clause 9.1.

9.3 You will remain liable for payment of any goods or services acquired by use of the Card issued to you at any time from issue of the Card until the contract is cancelled or use of the Card is suspended. If you notify us after 2:30pm on a working day for the Card to be cancelled, the notification will be deemed as given on the next working day.

9.4 If we cancel the use of the Card, the Card will be deactivated, and you must stop using it. If you try to use the Card after it has been cancelled or stopped, notwithstanding any other provision in these terms and conditions, you shall remain liable for all transactions made up to the point at which we deactivate the Card.

9.5 Where a Card is cancelled or the account is terminated before the Card has been used (i.e. where no Fuel purchase has been made using the Card) and the Cooling-off Period has expired, we will deduct a card issuance cost of £9 (the "Card Issuance Cost") from any refund otherwise due to you, to reflect the cost of producing and issuing the Card. Accordingly, the initial top-up of £10 paid in accordance with clause 8.1 shall be refunded to you less the Card Issuance Cost, and any additional amounts topped up by you beyond the initial £10 (including any amounts topped up to meet the Minimum Balance) shall be refunded to you in full, in each case in accordance with clause 9.1. For the avoidance of doubt, where at least one Fuel purchase has been made using the Card, the Card will be cancelled free of charge and any remaining Top-up Balance will be refunded to you in accordance with clause 9.1.

9.6 If the Card is terminated or cancelled for any reason, you must destroy all Cards issued to you by cutting through the magnetic stripe, the signature strip and the chip on each Card, and return the destroyed Cards within 7 days of the date of termination or cancellation to The Fuel Store, 14th Floor, Bank House, 8 Cherry St, Birmingham B2 5AL.

9.7 The termination of this contract, however it arises, does not affect any rights or obligations that have already accrued before the date of termination. Any terms of this contract that are stated or intended to continue in force after termination shall remain fully effective and enforceable.

10 We're not responsible for interruptions outside our control.

We will not be liable to you for the consequences of any interruption relating to the use of the Card caused by any circumstances beyond our control, such as issues with our card issuer, network outages, fuel supplier disruptions or IT system failures. We will contact you as soon as possible to let you know of any interruptions and take reasonable steps to reduce the interruption. As long as we do this, we will not be responsible for compensating you for the interruption. However, if the interruption is likely to be substantial, you may contact us at info@thefuelstore.co.uk to cancel the Card and end this contract, in which case we will refund any remaining Top-up Balance on the Card in accordance with clause 9.1.

11 You have rights if there is something wrong with your service

If you think there is something wrong with your service, please contact us by emailing info@thefuelstore.co.uk. Remember too that you have several options for resolving disputes with us for example alternative dispute resolution, which is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you’re not satisfied with the outcome, you can still go to court.

12 We can make changes to services and these terms

12.1 We can always change a service to reflect changes in relevant laws and regulatory requirements; and to make minor technical adjustments and improvements, for example to address a security threat. These are changes that don't affect your ability to use the Card.

12.2 We can also make changes to the Card or these terms and conditions, for example changing the discount applied to Fuel, but if we do so we will notify you and you can then contact us at info@thefuelstore.co.uk to end the contract before the change takes effect and receive a refund of any unused Top-up Balance on the Card in accordance with clause 9.1.

12.3 We may need to suspend the service from time to time, for example to fix technical problems, make minor updates, or comply with changes in law. We’ll normally tell you in advance if we need to suspend the service, unless the issue is urgent or relates to security. If we suspend the service or tell you that we’re going to suspend it for a long period, you can contact us to end the contract and receive a refund of any unused Top-up Balance on the Card in accordance with clause 9.1.

13 We don't compensate you for all losses caused by us or our services

We're not responsible for losses you suffer caused by us breaking this contract if the loss is:
    (a) Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).

    (b) Caused by a delaying event outside our control. As long as we have taken the steps set out in clause 10 ‘We're not responsible for interruptions outside our control’.

    (c) Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.

14 Transferring this contract

We can transfer our contract with you, so that a different organisation is responsible for supplying your service. We'll tell you in writing if this happens and we will ensure that the transfer won't affect your rights under the contract. You can only transfer your contract with us to someone else if we agree to this.

15 Nobody else has any rights under this contract

This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

16 If a court invalidates some of this contract, the rest of it will still apply

If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

17 Even if we delay in enforcing this contract, we can still enforce it later

We might not immediately chase you for not doing something or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

18 General

18.1 Nothing in these terms and conditions affects your statutory rights as a consumer. For further information about your statutory rights, you may contact your local Citizens Advice Bureau or Trading Standards office.

18.2 This contract is governed by the laws of England and Wales. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland, you can bring proceedings in Scottish courts, and if you live in Northern Ireland, you can bring proceedings in Northern Irish courts.
